Documents would be collected, checks would be run, and the outcome would be delivered. For most organizations, that checkbox was enough. It signaled permission. It signaled compliance.

Or at least, it felt like it did.

But with the introduction of the Digital Personal Data Protection (DPDP) Act, that quiet assumption is starting to unravel. Because the law doesn’t just ask whether consent was taken. It asks how it was taken, what it covered, and whether it actually means anything in practice.

And that changes more than just forms. It changes how background verification itself is designed.

The Checkbox Era Is Over

If you look closely, most consent mechanisms in traditional BGV processes were built for convenience, not clarity.

A single line—“I agree to background verification”—bundled everything together. Identity checks, employment verification, address validation, database screening. All covered under one broad, catch-all statement.

From an operational standpoint, it worked. It was fast, standardized, and easy to implement at scale.

But from a data protection standpoint, it was vague.

The DPDP Act challenges this vagueness directly. It introduces a more explicit expectation—that consent should be informed, specific, and purpose-driven. Not implied. Not bundled. Not assumed.

Which means that the old model of blanket consent starts to feel insufficient.

Not invalid, necessarily—but incomplete.

Compliance Was About Process. Consent Is About Intent.

There’s a subtle but important difference between compliance and consent.

Compliance is internal. It’s about ensuring that your organization follows a defined process. Documentation is in place. Policies are written. Checklists are completed.

Consent, on the other hand, is external. It’s about the individual. Their awareness. Their understanding. Their control over how their data is used.

In traditional BGV workflows, compliance often took precedence. As long as the process was followed and the consent box was checked, the system moved forward.

But the DPDP Act shifts the center of gravity.

It asks whether the individual actually understands what they’re consenting to. Whether they have the ability to withdraw it. Whether the data being collected is necessary for the stated purpose.

In other words, it brings intent into a system that was largely driven by process.

What This Looks Like in Practice

The impact of this shift isn’t theoretical. It shows up in everyday workflows.

Take something as simple as an employment check.

Earlier, consent for this might have been included as part of a larger agreement. Now, organizations need to be more precise. What exactly is being verified? Which employers will be contacted? What information will be shared during the process?

Similarly, for address verification, it’s no longer enough to just collect proof. There needs to be clarity on why that data is required, how it will be used, and how long it will be retained.

Even something as routine as database screening becomes more nuanced. If an individual’s data is being checked against multiple sources, the scope of that check needs to be clearly communicated.

This doesn’t necessarily make the process slower.

But it does make it more deliberate.

The Operational Tension

Of course, this shift introduces a new kind of challenge.

Background verification is often time-sensitive. Hiring timelines are tight. Onboarding needs to happen quickly. Any additional step—especially one that requires explanation or user action—can feel like friction.

This creates a tension between speed and clarity.

On one side, there’s the need to move fast and keep processes efficient. On the other, there’s the need to ensure that consent is meaningful and compliant with the law.

The instinct might be to minimize this friction. To keep consent flows as simple as possible.

But oversimplification is exactly what the DPDP Act is pushing against.

The goal isn’t to add complexity for its own sake. It’s to ensure that individuals are not unknowingly giving away control over their data.

Rethinking Consent as Part of the Experience

One way to resolve this tension is to stop treating consent as a one-time formality and start treating it as part of the user experience.

Instead of presenting a dense block of text, consent can be broken down into clear, contextual steps. Each type of verification can be explained briefly, with just enough detail for the individual to understand what’s happening.

This doesn’t have to be overwhelming.

In fact, when done right, it can build trust.

Candidates are more likely to engage positively with a process that feels transparent. They’re more likely to cooperate when they know what’s being checked and why.

In a way, better consent design can actually reduce friction, not increase it.

The Role of Technology in Bridging the Gap

This is where platforms like OnGrid play an important role.

Managing consent at scale—while keeping it compliant, auditable, and user-friendly—is not easy to do manually. It requires systems that can capture, store, and track consent in a structured way, while also integrating seamlessly with verification workflows.

More importantly, it requires flexibility.

Different checks may require different levels of consent. Different industries may have different compliance requirements. And individuals may exercise their rights—like withdrawing consent or requesting data deletion—at any point.

Handling all of this within a static system is difficult.

But with the right infrastructure, it becomes manageable.

Consent becomes something that is not just collected, but actively managed throughout the lifecycle of verification.

Beyond Consent: The Question of Data Minimization

Another subtle shift introduced by the DPDP Act is around data minimization.

Just because you can collect certain information doesn’t mean you should.

In traditional BGV processes, there was often a tendency to collect more data than necessary, simply because it might be useful. Additional documents, extra identifiers, broader checks.

The new framework encourages a more focused approach.

Only collect what is required for a specific purpose. Avoid excessive data gathering. Be intentional about what you ask for.

This not only reduces compliance risk, but also simplifies the verification process.

Less data means fewer points of friction, fewer storage concerns, and fewer questions from candidates.

A Shift That’s Easy to Underestimate

At first glance, the changes introduced by the DPDP Act might seem incremental.

After all, consent was already part of the process. Policies were already in place.

But the difference lies in how seriously these elements are now being treated.

Consent is no longer a checkbox. It’s a commitment.

Compliance is no longer just internal documentation. It’s something that needs to be demonstrable, auditable, and aligned with user rights.

And background verification, as a function that deals directly with personal data, sits right at the center of this shift.

Closing Thought

The conversation around background verification is slowly changing.

It’s no longer just about speed, accuracy, or coverage.

It’s also about responsibility.

About how data is collected, how it’s used, and how much control individuals have over it.

The DPDP Act doesn’t break existing systems. But it does challenge them to evolve.

And in that evolution, the difference between consent and compliance becomes more than just semantics.

It becomes the foundation of trust.

For years, background verification in India operated in a familiar rhythm.
